Terms of Service

These Terms of Service ("Terms") govern your use of apexops.dev and the products we sell on it. By using the site, submitting a form, or purchasing a product you agree to these Terms.

1. Who we are

APEX Ops is a San Diego-based operating company providing AI sales software and done-for-you deployment services.

2. Accounts and purchases

Purchases are processed through Stripe. You agree to provide accurate billing information. Subscriptions renew automatically at the interval displayed at checkout until cancelled. You can cancel at any time from your Stripe customer portal or by emailing info@apexops.dev.

3. Scope of service

• Website + Hosting: we deliver the website within seven business days of receiving the complete content brief. Hosting is provided month-to-month.
• AI Receptionist: we deliver the configured voice agent within five business days. Monthly fee includes unlimited call minutes subject to a fair-use policy of 5,000 minutes per month.
• Full Sales Machine: scope and timeline are specified in your statement of work. Monthly retainer covers continued operation and iteration.

4. Acceptable use

You agree not to use APEX Ops to send unlawful content, to target minors, to call numbers on the federal DNC list where no exemption applies, to make calls that violate TCPA or state-level anti-robocall laws, or to impersonate a person or entity. We will suspend accounts used for any of the above and we will cooperate with regulators.

5. Refunds

Setup fees are non-refundable once work has begun. If we fail to deliver a website within 30 days of receiving a complete brief, you get a full refund. Monthly hosting and subscription fees are not pro-rated on cancellation but no further charges will be made.

6. Intellectual property

You own the content you supply. We own the platform. The website we deliver is licensed to you for unrestricted use on your business domain — you can export the HTML and host it elsewhere if you ever cancel. AI-generated text and images produced on your behalf are licensed to you for commercial use.

7. Warranties and limitation of liability

The service is provided "as is." We do not warrant specific revenue outcomes, lead volume, or conversion rates. Our total liability for any claim arising out of the service is capped at the fees you paid us in the 12 months preceding the claim. We are not liable for indirect, consequential, or lost-profits damages.

8. Indemnification

You agree to indemnify us against third-party claims arising out of your content, the lists you upload, or your violation of these Terms or applicable law.

9. Governing law

These Terms are governed by the laws of the State of California. Disputes will be resolved in San Diego County courts. Either party may seek injunctive relief to protect intellectual property or confidentiality.

10. Changes

We may update these Terms. Material changes will be announced by email at least 14 days before taking effect. Continued use after the effective date means acceptance.
